PROCESS OF DIVORCE LITIGATION

Divorce litigation occurs when the two parties cannot come to an agreement on their own, which leads them to each hire a divorce attorney to represent them and fight for their separate interests. There is a general structure or sequence of events in a divorce litigation case:

  1. A petition for divorce must be filed with the court.
  2. The petition must be served to the opposing party and they are required to respond with either an agreement or a counter-petition.
  3. Temporary orders are requested, in which either party may request that certain actions of the opposing party be permitted or prohibited. These orders must all be taken to court and can occur at any time throughout the case.
  4. Discovery takes place, which is the process of obtaining all relevant information regarding the case from both parties.
  5. Mediation occurs, which in which a third-party mediator separately meets with both parties to try and come to a resolution. This is done in an attempt to avoid having to go to court and thus pay more in court fees.
  6. Deposition occurs, which is when both parties and counsels come together to ask and answer each other’s questions. Witnesses may be present too.
  7. The final stage is trial, in which all involved parties and witnesses go to court, each party testifies, evidence is given to the court, and a resolution is eventually reached.

A Final Decree of Divorce is signed by the judge and the case is closed. In some cases, there may be a party who is in disagreement with the final resolution, in which case they have the opportunity to appeal.
